Child abuse is an act or omission by an adult that endangers or impairs a child or young person’s physical, sexual or emotional health or development.
Any allegation of abuse or neglect must now be reported to the Department of Human Services (DHS) by the agency (CSO). Previously the agency had some discretion to judge whether it may be a malicious allegation.
The process is quite long, especially if the police are involved. Whether or not the police are investigating, DHS will make their own assessment on the balance of probability whether the abuse/neglect occurred. Therefore there may be two investigations happening at the same time (the police and the Department). The police need a higher degree of evidence to be able to charge a person with abuse.
It is important that the carers have a copy of the Guidelines for Investigating Allegations Against Home-Based Caregivers. If they do not have a copy, please arrange to have one sent from the office. The guidelines will help the carers understand the process and the timelines involved. It is also useful to have that information in case there is a complaint that the guidelines are not being followed.
- if a carer has an allegation made against her/him and the process is not being followed, then a referral is made to Allan Sharp, who is a carer and a lawyer
- Allan is contacted by the Helpline Co-coordinator and the contact details of the carer are passed on to him. His telephone number or email address are never given out to carers
- if the carer needs emotional support, a referral to Allan is not necessary
- support can simply be a listening ear – never underestimate the power of this. Carers often suffer considerable distress and isolation when an allegation is made.
- it is important that volunteers do not talk to the carer about details of the allegation.
This is because, if there is a court case, the volunteer may be required to give evidence in court about what was said by the carer. This is not the case with Allan as he is a lawyer. What is said to him is protected by lawyer/client privilege.
